Prospect Manor Manufactured Home Community Rules

 

1.     TO ENSURE A SAFE, PLEASANT, AND ENJOYABLE COMMUNITY: All mobile homes in the community shall be maintained in a clean, safe, and attractive condition by the site lease tenant (‘Resident’) and comply with all federal, state, village laws and ordinances, laws, regulations, and rules of the mobile home community.  This community is private property for residents and guests only.  All residents will be responsible to make sure their guests and their children’s guests conform to the community rules. 

2. EQUAL HOUSING OPPORTUNITY: It is the policy of the Community to offer equal housing opportunities to all qualified applicants. We encourage and support an affirmative advertising and marketing program in which there are no barriers, based on race, color, national origin, religion, sex, familial status, or handicap status, to obtaining housing in the Community. This policy is the law and is consistent with our philosophy, objectives, and practices. Landlord expects that the Resident, additional occupants, and their guests will treat all other residents and their additional occupants and guests fairly and with respect. If you believe that you are being discriminated against, you may contact the community office or the Regional Manager.

3. IMMEDIATE TERMINATION: Management will immediately terminate a Resident’s site lease if primary Resident, other occupant, or guest does any of the following:

A.    Drives a vehicle through the community at a dangerous speed or does any burnout.

B.    Is suspected of or commits criminal activity including but not limited to threatening or intimidating assault, street gang activity, theft, prostitution, drug related activity including but not limited to manufacturing, possessing, delivering, or possessing with intent to deliver a controlled substance on the lot, in the home, or within the common areas of the community.

C.    Any destruction of community property

D.    Physical or excessive verbal abuse

E.     Hosts a guest that has been previously evicted from the park.

F.     Any action that threatens another resident or staff member’s safety.

G.    Any causes listed in MCL 600.5775

4.     REGISTRATION: Prior to moving into the community all occupants, and pets, must be approved by the community management.  Any change in the number of occupants must be approved of by the management, prior to any changes.  Visiting guests that will be staying in the community for more than three nights must be approved of by management and are subject to a background check. Visiting guests are subject to the community rules and guidelines. If visiting guests break the rules, the homesite who is hosting the guest will receive a violation. Previously evicted tenants are not allowed back into the community as guests. Hosting previously evicted tenants is grounds for immediate site lease termination.

5.     NOTICE OF VIOLATION: Residents who violate a rule, procedure, or standard established by these Rules will be contacted by Management, either by personal visit, phone call, text, or issuance of a written Notice of Rule Violation. If a Notice of Rule Violation is issued, it is expected that the violation will be corrected by the date stated on the Notice. Failure or refusal to correct the violation within the given time frame will result in a $50 fine. Failure or refusal to correct a Violation within thirty (30) days from original issuance of Violation will result in termination of tenancy. Accumulation of three Violations will result in termination of tenancy.

6.     HOME STANDARDS: All mobile homes must be built to the minimum requirements of the HUD Mobile Home Construction and Safety Standards currently in effect and Appendix B – Home Standards and Installation. The exterior of all mobile homes: roofs, doors, windows, siding, paint, etc., must always be in good repair. Additions to the mobile homes, sheds, steps, porches, skirting and must be approved by management and in good repair (reference Appendix B). Skirting shall be state and locally approved, kept neat and clean, and of uniform color. Proper window treatments must be used (no sheets, towels, blankets etc.) Window air conditioners must be braced to the mobile home with metal angle braces or chain braces. Existing awnings must be in good repair, and new awnings must be approved by management. Homes must be labeled with a lot number made from commercially available materials, not painted on.

7.     SITE STANDARDS:

(a)   General Cleanliness. Residents are responsible for maintaining their sites in a clean and orderly manner at all times. This includes keeping the yards free of debris, trash, and clutter. Items such as toys, tools, tents, hammocks, tires, construction materials, appliances, folding lawn chairs, and tools cannot be stored out in the yard.

(b)   Trash Disposal. Residents must properly dispose of all trash and waste in designated receptacles. Trash should not be left outside of homes or in common areas.

(c)   Outdoor Storage: All outdoor storage, including but not limited to furniture, and personal belongings, must be kept in a neat and organized manner. Items should not be stored in a manner that creates an eyesore. Residents are encouraged to have sheds as a way of keeping the lot clean and neat. The shed must be in good repair. Bikes and lawnmowers must be stored against the home or in a shed.

(d)   Yard Maintenance: Yards should be regularly mowed, trimmed, and kept free of weeds. Maximum allowed grass height is 5 inches. Plants, shrubs, and trees should be pruned to prevent overgrowth. Management will conduct ‘forced maintenance’ of sites where landscaping or lawn is not maintained, without warning, and will post a charge to tenants accounts. Forced mow: $15, Forced weed whip: $10, Forced landscaping pruning and maintenance: $30 / hour. Any landscaping beds not regularly maintained must be removed. Management reserves the right to remove landscaping that is not maintained and plant grass in its place.

(e)   Miscellaneous: Fences are not permitted. American flags only, other flags are not permitted. American flags must hang from a flagpole. No flags hanging from the home. No signs other than ‘For Sale’ signs are permitted. No trampolines or swimming pools are permitted. No chickens or other livestock. No shopping carts

8.     VACANT SITES: No storage of vehicles or items is allowed to be stored on vacant homesites without the management’s consent. Management reserves the right to charge rent for approved storage on vacant sites.

9.     LANDLORD'S RIGHT TO ENTER: Landlord may enter onto resident’s site outside the home to inspect, repair, make alterations or additions to or on the premises, to protect the community or to repair utilities which are the responsibility of Landlord.

10.  GARBAGE REMOVAL AND DUMPING: Garbage pickup is on designated days, in the designated garbage container area. Residents are required by law to keep their lots free and clear of all garbage, debris, fire, or health hazards. Registered tenants are only allowed to use the garbage containers. No outside dumping. No disposal of large items in the dumpster. If the item does not fit in the 8-yard container, it cannot be disposed of there. No leaving large items beside the dumpsters. Violating this rule constitutes a $300 fine.

11.  CLOTHES LINES: Clothes lines are allowed but must be put away when not in use.   

12.  MOTOR VEHICLES AND TRAILERS: The posted speed limit must always be observed. Limit of three vehicles per mobile home unless written permission for more vehicles is granted by the Landlord. Vehicles must be in working condition.   Michigan State law requires that all unlicensed, unregistered, and inoperable vehicles be removed from a mobile home community.  Any cost of doing such will be the residents responsibility. Parking vehicles is not allowed on your lawn, lot, or any vacant lots.  Residents are responsible for keeping their parking spaces free and clear of snow and ice during the winter months.  Residents will be responsible for moving all vehicles at the management's request for road maintenance.  No commercial or oversized vehicles are allowed on community property without the permission of the management.  Excessively loud vehicles and muffles are to be repaired immediately. Flat tires must be repaired immediately. Vehicles parked for more than seven days with a flat tire will be considered inoperable and towed. Residents may not repair vehicles on premises if said repair takes longer than 1 day. No vehicles resting on car jacks unattended. The storage or parking of boats, boat trailers, utility trailers, or similar large recreational vehicles on mobile home park premises is prohibited.

13.  HOME SITE SNOW AND ICE REMOVAL: Home site snow and ice removal is the responsibility of the Resident.

14.  MINORS: Minors under 10 must be on their own lots by dusk or when the community streetlights come on, unless accompanied by a responsible adult. Minors are not allowed to play in the streets, neighbor’s lots (without permission of the neighbor), vacant lots, near construction or park operating areas. Parents will be held accountable for minor’s actions.

15.  PETS: Limit of three pets per home site unless written permission for more pets is granted by the Landlord. All pets are required to be approved by management prior to living in the community. All pets must be registered with management. Pets are required to have any necessary inoculations to be able to reside in the community. Outside pet pens must be approved by management. Pets may not be leashed outside when the Residents are not at home. All pets must be on a leash held by the owner or cable tethered to the home or ground. No pets will be allowed to run loose in the community at any time. All pets must wear a tag identifying the owner. Management reserves the right to remove free ranging pets. Pet owners are responsible for any damage or injury caused by their pet and agree to indemnify the owners and management against any damage or injury caused by their pet(s). Pet waste must be removed from the home site daily. If pet waste is outside of your homesite the waste must be picked up immediately. Constant barking and aggressive behavior are prohibited. The management will require the removal of any dangerous pets or those that become a nuisance to the other residents. Due to insurance reasons, dogs of dangerous breeds are not allowed in the community.

16.  MOVING OUT AND ONSITE RESALE: The right to occupy a home on the lease site is not transferable when manufactured home ownership transfers. Ownership transfer of the mobile home must meet the following criteria: (a) Resident agrees to give Landlord the Right of First Refusal when attempting to sell their home. (b) If the home is to remain on the leased site, the buyer must apply for and be approved for residency prior to sale closing. If the purchaser of a home occupies the home without first obtaining Landlord's approval for residency, the purchaser will be deemed to be a trespasser and will be evicted from the community.(c) Buyer of the home must provide a copy of the bill of sale/title showing the transfer of ownership within ten (10) days of the sale.  If a copy of the title is not provided to Landlord within the ten (10) days, the buyer’s approval into the community may be revoked.(d) All rent and other charges owed by Resident must be paid to Landlord prior to the closing on the sale of the home. No tenancy is transferable, and Resident's tenancy continues until the purchaser executes a new lease for the home site (e) If a home is sold in violation of these provisions, Resident will remain responsible for all rent and other charges which may accrue, regardless of whether the Resident continues to occupy the home or holds title to the home.

17.  SUBLEASING: Subleasing of mobile homes within the community is allowed with written approval from Community Management. Residents must submit a completed sublease application, including details about the proposed sublessee, to Community Management for approval. All sublessees must adhere to all community rules and regulations, and the original resident is responsible for their compliance. Community Management reserves the right to refuse a sublease and may conduct background checks on proposed sublessees. Any changes to the sublease agreement must be promptly communicated to Community Management, and failure to comply with subleasing guidelines may result in penalties or eviction. Residents engaging in subleasing must acknowledge that the site lease with the mobile home park remains in the name of the original homeowner (lessee). The sublessee is bound by the terms of the sublease agreement with the homeowner and does not have a direct contractual relationship with Community Management. The original homeowner retains full responsibility for compliance with park rules and regulations as outlined in the site lease.

18.  ADVERTISING AND SOLICITING: Advertising and soliciting within the community are not permitted. Landlord reserves the right to communicate with Residents through distribution of written materials from time to time.

19.  QUIET HOURS: Quiet Hours are designated times during which residents must minimize noise levels. Quiet Hours are in effect from 10:00 p.m. to 7:30 a.m. every day. During Quiet Hours, residents and their guests must refrain from activities that could disturb neighbors, including but not limited to loud music, television, parties, and construction noise. Quiet Hours do not apply to emergency maintenance or situations requiring immediate attention.

20.  CONDUCT: All audible noises of any kind and/or nature shall always be maintained at acceptable levels as determined by management. Drunkenness, obscene language, immoral conduct, disorderly conduct, or illegal drug use will not be permitted on the property and will be reported to the authorities. Nothing may be done on the homesites which would interfere with quiet enjoyment or safety of other residents. Residents shall be held responsible for his/her/its guest's actions. Alcohol and drug use are not permitted in any of the community’s common areas.  Peddling, soliciting, or running a commercial enterprise is not permitted in the community. Any abuse and/or destruction of the Mobile Home Community property or the property of other residents will subject the Resident to immediate eviction. All traffic regulations shall be observed and obeyed throughout the Mobile Home Community. Streets are not to be used for recreational purposes except for walking and bicycle riding. Operations of minibikes, motor scooters, dirt bikes, go-karts or snowmobiles are not permitted in the Mobile Home Community. Equipment or machinery is not allowed on the home sites. Licensed motorcycles may be ridden to and from the Resident’s home site. Residents/Homeowners of each mobile home site shall be responsible for keeping said mobile home site free of fire hazards. No open fires. Bonfires only with management's consent. No firearms, Bow and Arrow, B-B guns, Pellet guns, fireworks, or projectile-shooting toys shall be discharged or used in the Mobile Home Community.
